Vietnam's Landmark Piracy Prosecution: A Step Towards Stronger IP Protection
Vietnam intensifies its fight against intellectual property violations with its first copyright infringement case involving Japanese media, responding to international pressure.

HANOI -- Vietnam has launched its first copyright infringement case involving Japanese media, targeting a website suspected of streaming anime and movies with Vietnamese subtitles. This action is part of the country's intensified efforts to combat intellectual property (IP) violations, which have long plagued its digital landscape.
The prosecution comes in the wake of increasing pressure from the United States and Japan for Vietnam to strengthen its IP laws. According to the Vietnamese Ministry of Foreign Affairs, the government is committed to rigorously addressing all forms of IP infringement and enhancing the enforcement of IP rights. Phạm Thu Hằng, the ministry's spokesperson, emphasized that Vietnam will continue to improve its legal framework to meet international standards and commitments under new free trade agreements.

In recent years, Vietnam has made significant strides in reforming its IP laws, with the latest amendments to the Intellectual Property Law set to take effect in 2025, aiming to align with global practices. The World Intellectual Property Organization (WIPO) has recognized these efforts, ranking Vietnam 44th out of 139 countries in the Global Innovation Index, reflecting positive outcomes in IP protection within ASEAN.
Vietnam's ongoing crackdown on piracy is not only a response to international demands but also a necessity for fostering a healthier business environment. The General Department of Market Management reported that from 2021 to 2023, thousands of cases related to IP violations concerning Japanese products were processed. This includes significant penalties for counterfeit cosmetics and food products, which are prevalent in the Vietnamese market.
As part of its commitment, the Vietnamese government has rolled out various directives aimed at enhancing IP enforcement. A recent directive from Prime Minister Phạm Minh Chính called for decisive actions against IP infringement, indicating a strong governmental resolve to combat counterfeiting and protect consumers.

Moreover, Vietnam has been collaborating with Japanese authorities to bolster IP protection. A workshop held in February 2023 between the General Department of Market Management and the Japan Patent Office (JPO) highlighted the importance of joint efforts in tackling IP violations. The meeting reviewed the implementation of a memorandum of cooperation signed in 2021, which aims to strengthen the enforcement of IP rights and address the growing challenges posed by counterfeit goods.
In the context of increasing online commerce, the complexity of IP violations has also risen. The government is focusing on establishing effective mechanisms for cooperation between regulatory bodies and e-commerce platforms to ensure better enforcement of IP laws in the digital marketplace. Trần Hữu Linh, head of the General Department of Market Management, pointed out that ongoing collaboration with major e-commerce platforms is crucial to combatting IP infringement effectively.
